Terms of Use

The terms that govern your use of Creating Health and its membership tiers.

1. Who we are, and what these terms cover

Welcome to Creating Health — the digital home of Dr Bernard Brom’s writing, protocols and teaching. These terms are the agreement between you and us when you use the site or join as a member. ‘We’ means Dr Bernard Brom, trading as Creating Health (a sole proprietorship); ‘you’ means anyone who uses the site, whether reading the free library or joining as a paying member.

By using the site or joining, you agree to these terms. Please also read our Privacy Policy and the medical disclaimer that appears on our content, which form part of this agreement.

2. The service

Creating Health publishes educational health content — articles, a monthly newsletter, protocols, courses and videos. It is a publishing and membership platform, not a clinical service. We do not provide consultations, diagnoses, prescriptions or individualised medical advice, and using Creating Health does not create a doctor–patient relationship. Please see section 8.

3. Membership tiers

Creating Health offers three tiers:

  • Standing in the Field — free. Open access to selected writing, the public newsletter, and general protocol guidance.
  • Looking for Direction — the complete monthly letters, the members’ continuation of the essays, every protocol with its doses, timing and cautions where these have been published, The Lounge, and Bernard’s books Healthy Medicine and The Heart of Healing to read or download.
  • Finding Home — everything in Looking for Direction, plus The Circle, the advanced and practitioner-level writing, and Bernard’s mind maps — included at no extra cost and delivered to you as each is released.

Pricing. The current price of each paid tier, and whether you’re paying monthly or annually, is shown to you on the membership page and again at checkout before you pay. All prices are in South African Rand. We may change our prices, but a change will never affect a period you’ve already paid for; we’ll tell you before your next renewal at a new price.

Finding Home and practitioner content. Some Finding Home material is written for practitioners and may be advanced or exploratory. Access is currently by self-declaration — when you join Finding Home you confirm the basis on which you’re joining. Finding Home is open to committed students of the work, not only licensed practitioners; you do not need a medical licence. You are responsible for using advanced material sensibly and within your competence.

4. Your account

To join a paid tier you’ll create an account. You agree to give accurate details, keep your login secure, and not share your account or member content with people who aren’t members. You’re responsible for activity under your account, and you must be 18 or older to hold a paid membership. Creating Health is not directed at children.

5. Billing, renewals, cancellation and refunds

How payment works

Payments are processed securely by PayFast, a South African payment gateway. We never see or store your full card number. For a recurring membership, PayFast securely stores your card and we charge your chosen tier each cycle.

Renewals

A monthly membership renews every month, and an annual membership renews every year, automatically, at the price shown when you joined or most recently renewed, until you cancel.

Cancelling

You can cancel at any time from your account page — there are no lock-in periods and no cancellation fees. When you cancel, your membership continues until the end of the period you’ve already paid for, and then stops. After that, your account returns to Public Library (free) access: you keep the free content and lose the member-only material.

Annual memberships — cancelling early

If you’re on an annual plan and want to cancel before the year is up, you can. We’ll stop future renewals and refund a reasonable pro-rata portion of the unused part of your year, less any discount you received for paying annually rather than monthly and a reasonable administrative amount. We won’t charge an unreasonable penalty.

Failed payments

If a renewal payment fails, we may pause or end your member access until payment is sorted out. We’ll let you know if that happens.

6. Using Creating Health responsibly

Creating Health is a considered, respectful space. When you use it, please don’t: copy, republish, resell or redistribute member-only content (writing, protocols, books, videos or PDFs), or share your login, beyond your own personal use; remove or obscure any watermark, author credit or copyright notice; scrape or bulk-download the content, or use automated tools against the site; upload anything unlawful or that infringes someone else’s rights; attempt to get around the site’s security or access controls; or use the platform to give anyone medical advice as though you were their practitioner. If you seriously or repeatedly break these rules, we may suspend or close your account, and we’ll act fairly about any refund of unused, pre-paid time.

7. Who owns the content

Dr Bernard Brom owns the content. The writing, protocols, course material, videos, books and other works on Creating Health are his intellectual property (or, where stated, their respective owners’), protected by copyright, as are the Creating Health name and look-and-feel. When you join, we give you a personal, non-exclusive, non-transferable, revocable licence to access and enjoy the content of your tier, for your own personal, non-commercial use, for as long as your membership lasts. You don’t acquire ownership of anything, and the licence ends when your membership does.

8. Health information — not medical advice

Everything on Creating Health is educational. It reflects Dr Brom’s clinical experience and research into how the body’s own healing can be supported. It is not medical advice, not a diagnosis, and not a prescription, and it is not a substitute for individual consultation with a healthcare practitioner who knows your history. Protocols may include doses, timing, herbs and nutrients that can interact with medicines or existing conditions — speak to your own doctor or qualified practitioner before acting on any of it, and especially if you are pregnant or breastfeeding, are managing a diagnosed condition, are taking medication, or are caring for a child or older person.

Never delay or disregard professional medical advice because of something you read here. In an emergency, contact your local emergency services.

9. Members’ PDFs and watermarking

Some members’ materials (such as Mind Maps and books) can be downloaded as PDFs. When you download one, it is stamped with your email address and member ID. This personalises the file to you and helps us discourage sharing of paid material. By downloading, you agree that the file is licensed to you personally and is not for redistribution or resale, that it carries your email and member ID as a watermark, and that sharing or publishing the file, or removing the watermark, breaks these terms.

10. Availability, and our liability

We work to keep Creating Health available and accurate, but we can’t promise it will always be uninterrupted or error-free, and content may change over time. To the extent the law allows, and except where we may not lawfully limit our liability (for example, for death or personal injury caused by our negligence, for fraud, or for gross negligence): we are not liable for indirect or consequential loss; our total liability to you in any 12-month period is limited to the amount you paid us for your membership in that period; and we are not responsible for the consequences of how you choose to apply educational content — which is why we ask you to work with your own practitioner. Nothing in these terms limits any right you have under the Consumer Protection Act that cannot be limited.

11. Suspension, closure and these terms ending

You can close your account at any time. We may suspend or close an account that seriously breaches these terms, or if we have to for legal or security reasons. If we stop offering the platform altogether, we’ll give members reasonable notice and deal fairly with any unused pre-paid time.

12. Changes to these terms

We may update these terms — for instance if the platform or the law changes. If we make a significant change, we’ll tell you before it takes effect, so you can decide whether to continue. The current version always lives at creatinghealth.co.za/terms.

13. Governing law and disputes

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. If something’s gone wrong, please talk to us first — most things are sorted out quickly by email to hello@creatinghealth.co.za. You also keep any right you have to refer a complaint to the Consumer Goods and Services Ombud, the National Consumer Commission, or, for privacy matters, the Information Regulator.
